Sick Leave Policy Update for Substitute & Temporary Employees

On October 4, 2023, Senate Bill 616 was signed into law and made the following changes to the paid sick leave policy beginning January 1, 2024.
 
Eligibility: All non-bargaining unit employees (including substitutes and retirees) 
 
Eligibility Criteria: Non-bargaining employees must work 30 days or more within a year of their hire date (the days do not have to be full work days). 
 
Sick Leave Accrual: Hourly non-bargaining employees will earn 1 hour of paid sick leave per 30 hours worked, up to a maximum of 40 hours (from 24 hours through December 31, 2023) in each year of substitute employment. Daily non-bargaining employees will earn 1 day of paid sick leave per 30 days worked, up to a maximum of 5 days (from 3 days through December 31, 2023) per year. 
 
Sick Leave Use: Sick leave can be used beginning the 90th work day. Up to a maximum of 40 hours or 5 days may be used per year. Unused sick leave can carry over to the following year, with a maximum cap of 80 hours or 10 days (from 48 hours or 6 days through December 31, 2023), as long as the substitute employee is still employed by ABCUSD. Should a non bargaining employee terminate with the District and be rehired within 12 months, their sick leave balance will be reinstated.
